What Personal Information We Collect PC Mall collects personally identifiable information that you specifically and voluntarily provide on the Site or by email to PC Mall. Personally identifiable information ("PII”) is information that identifies you as specific individual, for example, your name, your company name, account number, physical or email address, and phone number - Make a purchase

How We Use the Personal Information We Collect We use the PII that you provide to us in order to 1) fulfill requests for products, services and/or information, 2) provide customer service, 3) offer new products and services, 4) measure and improve the effectiveness of our Site and or marketing endeavors, 5) tailor our online offerings to your preferences, 6) administer promotions or surveys, 7) achieve other business purposes as permitted under applicable law. When you make a purchase in our Site we collect credit card information including card number, card type, cardholder name and billing address, and expiration date in order to bill you for purchases made through PCMall. Please review our credit card policy for additional information. PC Mall may share PII with third parties for marketing and other business of PC Mall and our affiliates. For example, PC Mall may disclose Pll to consultants, professional advisors and contractors who perform services on our behalf. At times PC Mall may seek to validate the PII we have collected via an audit by a third party designed to determine the accuracy of and/or to update information collected. We may also combine data that we collect online with data collected offline (such as through purchases made through one with our catalogs), or with data provided with other parties. PC Mall reserves the right to release Pll concerning any visitors when that visitor is believed by PC Mall to be in violation of any published guidelines for the use of the Site or participates (or is suspected of participating) in any legal or potentially illegal activity. PC Mall also reserves the right to disclose PII to comply with applicable law in response to civil subpoenas or discovery requested or when we believe in good faith that disclosure is required to protect the rights, property, safety or security of PC Mall, our visitors or the public or to respond to an emergency. PC Mall may share PII collected from our visitors and customers with our affiliated or related companies, including our parent company, affiliate, and subsidiaries of our parent company's other subsidiaries( collectively, our "affiliates"). We also may share PII with an affiliated third parties, such as our marketing or business partners. For purposes of this Policy, "unaffiliated third parties" are third party individuals or entities not affiliated with PC Mall of our affiliates. If you do not wish for us to share your PII to with unaffiliated third parties for direct marketing purposes please refer to the paragraph below entitled "Correcting/Updating Your Personal Information and Preferences". In the event that we sell or otherwise transfer to a third party assets related either (a) to the Site (b) to one or more of our businesses, divisions or affiliated companies, we reserve the right to also transfer any and all information (including any Pll) associated with the Site and/or any business, division or affiliated company to such third party. Special Notification for California Residents Individual customers who reside from California and have provided their Pll to PC Mall may request information about our disclosures of certain categories of Pll to third parties for direct marketing purposes. Such requests maybe directed to Mailing Management Department, 1940 E. Mariposa Ave, El Segundo, CA 90245. Within thirty days of receiving such a request, we will provide a list of categories of our customer Pll that have been disclosed to third parties for direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of those third parties. This type of request may be made no more than once per calendar year. We reserve our right not to respond requests submitted other than to the mailing address specified to this paragraph. Marketing Communications: Opting Out When you provide Pll to us, including when registering to receive email newsletters, catalog subscriptions or other information, or to make a purchase, PC Mall provides you with the opportunity to opt- out of having your Pill used by PC Mall to send you advertising or promotional materials. Unless you have opted out of receiving such marketing materials PC Mall may use your Pll to forward you via email, or mail advertisement concerning PC Mall products, services, special promotions, surveys or other opportunities from PC Mall that we think may be of interest to you. Such advertisement may also concern third party companies, products and services including companies in industries such as hardware and software, and other providers of the types of products that are sold or featured in the site. PC Mall has partnered with unaffiliated third parties to offer our customers and Site visitors a variety of products and services. PC Mall may share Pll (such as physical mailing address - but not your email address) with our third -party marketing partners in order for them to offer you additional products and services that PCMall believes that maybe of interest to you. Although we only worked with third parties whom we believe to be reputable, our third- party marketing partners may have different privacy policies and practices than PC Mall. We are not responsible for the privacy practices of our marketing partners or any other third parties. Should you wish to change your preferences regarding the marketing information that you receive from PC Mall or it's affiliates, or would prefer that we not share your Pll with unaffiliated third parties for their direct marketing purposes, please refer to the paragraph below entitled "Correcting/Updating Your Personal Information and preferences". Cookies Upon visiting our Site we will assign you a unique ID in the form of a "cookie". A cookie is a piece of information that our server places in your computer's hard drive, which PC Mall may associate with your Pll when you log on to the site. Cookies are use for such purposes as facilitating and personalizing your shopping and ordering experience, keeping track of your shopping basket during your visit, helping diagnose problems with our server and administering our Site. We may use the information collected through cookies for marketing purposes to inform you of special offers, better understands your needs or answer your questions. NOTE: You can control how and whether cookies will be accepted by your web browser, and you may remove them from your computer at any time at your discretion. Web Beacons Some of PC Mal Web Pages and HTML -formatted e-mail newsletters may use Web Beacons to compile aggregate statistics about website usage. A Web beacon is an electronic image often called a single- pixel (1x1) or clear GIF, that is ordinarily not visible to the site visitor. Web beacons can recognize certain types of information on a visitor's computer, such as visitor's cookie number, time and date of page or image view and description of the page where the web beacon is place. When used in an e-mail they can tell us whether an e-mail has been opened. How We Protect Your Personal Information To help ensure the security of your Pll, PC Mall seeks to use security technology and procedures, which are reviewed periodically. We use encryption technology and Secure Socket Layer ("SSL") in all areas where your personal account information is required. This means that the Pll you submit to us via our Site is encrypted by your computer and decrypted again in our side, discouraging others from accessing your private information during transmission. If your browser does not support SSL, or if you are unable to establish a secure connection due to company firewall, please call us at 800-555-MALL to place your order by phone. In addition, your personal account information, and transaction history are kept behind firewall. Correcting/Updating Your Personal Information and Preferences If you would like to opt- out of having your Pll shared with unaffiliated third parties for their direct marketing purposes, or to make changes to your Pll or to your preferences regarding the marketing information that you received from PC Mall or our affiliates, please click here. We will use reasonable efforts to comply with your request. Please note that we may need to contact you in order to be sure that we are updating the appropriate information. When requesting that Pll be updated or that your preferences be changed, please keep in mind that until the changed is implemented, you may still receive email and/or physical email from us. Furthermore, there will be residual in formation that will remain with PC Mall databases, access logs and other records which may contain such Pll. The residual information will not be use for commercial purposes; however, PC Mall reserves the right from time to time, to re-contact former customers or visitors to the Site. Please note that we are responsible for retracting your Pll from third parties which whom we have shared your information pursuant to the terms and conditions of this Policy as in effect from time to time. Other Information We Collect Information About Your Computer and your Site Activities: When a visitor comes to our Site we collect and aggregate information about the visitor's computer such as (IP, operating systems and browser software), and click stream information (such as address or "URL") of the website that the visitor came from before visiting our Site, which pages of the Site were visited, the other in which they were visited and which hyperlinks were clicked for the purpose of assessing our Site traffic and the effectiveness of our Site content, as well as to help diagnose problems with our servers. This data allows us to improve the quality of your visit by streamlining your ability to navigate the Site and to develop featured programs and content that will be of interest to our customers and Site visitors. Aggregated Information: PC Mall may collect and aggregate demographic information about our Site visitors. In an effort to better support our customers by delivering more relevant marketing communications, PC Mall will, in an occasion, purchase third party information about businesses and other entities that are our customers. The company information we purchase may include number of employees or annual sales information to better serve you. Advertisers PC Mall may use outside advertising companies ("Advertisers") to serve advertisements on the Site. Please be advised that such Advertisers may use cookies or other technologies to enable such Advertisers to record which ads your browser has seen, and which Site pages you may have been viewing when the ads were delivered. Sweepstakes and Promotions We may inform from time to time offer sweepstake, contests, or other similar promotions on the Site. Additional Pll may be required in order to participate in such promotions, so that we may, for example, verify entrants’ eligibility, and identify and notify winners. Participation in such promotions is completely voluntary. If and when sponsor such promotions, we will post relevant privacy information in the respective "official rules" and/or registration areas for such promotions. The privacy information, to the extent it conflicts with this policy, will govern that particular sweepstakes, contest or promotion--please remember to read it carefully. Our companies may offer sweepstakes, contests or similar promotions through our Site, including through the Rebate and Coupon Page. PC Mall is not responsible for any such promotions offered by third parties. Please read all related terms and conditions carefully, or contact the applicable third party for more information. The collection and use of Pll in connection with such promotions is governed by such third party's privacy policy, and not by the policies of PC Mall. Co Branded Sites: Links to Other Sites The Site offers certain features that are provided and/or hosted by third parties, but they may be presented on pages displaying PC Mall's branding. For example, PC Mall branded pages featuring investor relations information about PC Mall maybe created and operated by a third party data provider specializing in such information. The Site may also contain links to other Web sites, or affiliated sites (e.g. events, sponsors, or companies offering rebates or other promotions through our Rebates and Coupon Page). We are not responsible for the privacy practices or the content of any such Web sites, including such site's use of any information (such as IP number, browser type or operating system) collected when visitors to the site click through links to those sites. Even though such information may not identify you personally, we strongly encourage you to become familiar with the privacy practices of any third party sites. PC Mall Return Policy PC Mall prides itself on a tradition of outstanding customer care and support. Our devoted team of account representatives understands that our customers are the hallmark of our enduring partnerships. It is important for our customers to understand the standards that have been established within our industry regarding the terms and conditions of a sale. The purchases of computers, peripherals, software, and other consumer electronics are subject to manufacturer restrictions which may be different from other product purchases you transact. Most of the products sold by PC Mall are subject to a manufacturer's warranty. The warranty provided by the manufacturer is the first place to look for assistance with difficulties that may accompany your purchase. We encourage you to request information from any of our account executives about extending the service period on any of the products that you purchase. Most manufacturers offer a one year warranty on all new equipment. During the warranty period, you may call the manufacturer to receive warranty service. The manufacturer will attempt to solve your problem via phone. If a situation extends beyond the manufacturer's service centers ability to resolve, please contact your PC Mall representative for further guidance. APPLE COMPUTER PRODUCTS: Apple products are non-returnable: Apple Computer offers a one year warranty on all new equipment. During the warranty period, you may call 1-800-275-2273 to receive warranty service. Apple will attempt to solve your problem via phone. If they are unable to solve the problem, they will either dispatch a replacement via Airborne Express or will direct you to the closest Apple service center. In most cases, contacting the 800 number is the most expedient manner to obtain warranty service on Apple equipment. If a situation extends beyond Apple or an Apple service center's ability to resolve, please contact your sales representative for further guidance. CUSTOM CONFIGURATIONS: No returns or refunds will be made for items that are special ordered for you or for unusual custom configurations of systems. OTHER NON-RETURNABLE PRODUCTS: Several manufacturers' policies and restrictions disallow product returns. The following manufacturer's products (not all inclusive) are also not returnable to PC Mall: 3Com, Compaq, Cisco, IBM, Intel, HP, Toshiba, Adobe, Quark, Lenovo, Sony and Polycom. Other manufacturers apply to this list, so please call us for the latest information. You will need to contact the manufacturer directly regarding return or replacement of these brands under their respective guarantees and/or warranties. Please contact us if you would like to obtain copies of the manufacturers' guarantees and warranties prior to purchase. Items with a money back guarantee from the manufacturer. Some items offer a Money Back Guarantee from the manufacturer (a "MBG"). In those instances, PC Mall will not accept product returns. You will need to contact the manufacturer directly regarding return of the product and policies regarding such return. Please contact us if you would like to obtain copies of manufacturers' guarantees and warrantees, including any MBG, prior to purchase. TELEVISION RETURNS: Returns of televisions 27 inches or larger are subject to the following restrictions - Upon delivery, please inspect the television carefully for damage while the shipper is still present. If you discover any damage, please refuse delivery and you will receive a refund of the purchase price, shipping and handling fees, and sales taxes (if any). You must sign the shipper's release form which acknowledges this return policy.
- If, after delivery, the television does not work, all returns, in-house servicing (if applicable), and warranty repairs are handled exclusively by the manufacturer. Televisions 27 inches or larger cannot be returned to PC Mall.
- You can obtain copies of warranties through PC Mall, or directly from the manufacturer.
SOFTWARE: Opened software Opened software is not returnable. Unopened software, after 7 days of receipt of product, is also not returnable. All licensing sales are final. Defective Software: Defective software may be returned within 7 days of invoice date only for exchange of the same title. Original shipping charges are not refundable. Shipping charges on returned software are the responsibility of the customer. DAMAGED SHIPMENTS: If your shipment arrives damaged: Shipment must be refused if you notice any visible damage or tampering on the box. Should the shipment be accepted, you must note the damage on the carrier's delivery record in accordance with the carrier's policy, save the merchandise in the original box and packing it arrived in, and notify PC Mall immediately to arrange for a carrier inspection and pick up of damaged merchandise. Concealed damage on a shipment must be reported within 7 days. If you do not notify PC Mall of damaged goods within the first 7 days of arrival, the regular return policy will override any claim of damage, and your purchase(s) will fall under all current manufacturer restrictions.
DEFECTIVE / DEAD ON ARRIVAL NON-SOFTWARE PRODUCTS: Certain products (excluding Apple and the product manufacturers listed above) may be approved for return by the technical support division of PC Mall if reported to PC Mall within the first 15 days after receipt of shipment, and only after support from the original manufacturer has been receivedl. The return must be 100% complete, in original and resalable condition, with all original packaging, manuals, registration card(s) and software. Original shipping charges are not refundable. Shipping charges on returned products are the responsibility of the customer. PC Mall will match the shipping method and pay for shipping charges on replacement or exchange products. All late, non-defective, and/or incomplete returns are subject to minimum 15% restocking fee.
NON-DEFECTIVE PRODUCT RETURN: Customers may return most non-defective items (subject to manufacturer's return policy) to PC Mall within 30 days of invoice, either for credit or exchange. An automatic 15% restocking fee applies. All shipping charges are not refundable. ORDER DISCREPANCIES: Any order discrepancies, i.e, missing items/components; mis-shipments; short-shipments, must be reported either to your PC Mall Account Executive or to the Customer Service Department within 5 days of receipt of the shipment. NON-RETURNABLE ITEMS: Specialty Orders, Custom Built Configurations of Systems, Open Box Product.
HOW TO RETURN PRODUCTS:
Obtaining an RA Number: Please contact either your account executive or the Customer Service Department y phone at 1-877-233-9124 within 30 days of purchase for a Return Authorization (RA) number before returning your product to PC Mall. If the request meets the return criteria, the Returns Department will issue the RA# and send you the instructions on how to proceed. No returns of any type will be accepted without a RA number. For faster service, please have the following information on hand when calling for an RA number: customer name, order number, item number and serial number and the reason for the return. Upon receipt of a RA, customers are given 15 days to return the product.
Original shipping charges are not refundable. Shipping charges on returned products are the responsibility of the customer. Where applicable, PC Mall will match the shipping method and pay for shipping charges on replacement or exchange products. We strongly recommend you use a traceable carrier and fully insure your return shipment in case of loss or damage. Restocking/processing fees: All refused orders will be subject to a minimum 15%restocking fee. Refused orders may be subject to additional shipping charges to cover the cost of returning the products to PC Mall. A minimum restock/processing fee of 15% will be applied to products returned as defective that test to be operational upon return. Additionally, any items returned with missing accessories or is incomplete/not original packaging will be subject to the minimum 15% restock fee. |

Anticipated delivery dates are based upon vendor supplied information and are subject to change. Typographic, Photographic and Technical Errors Although we do our best to achieve 100% accuracy, occasionally errors and inaccuracies do occur. Should you encounter an error or inaccuracy, please inform us so it can be corrected. Products and packaging depicted may differ from stock available at the time of shipment. We reserve the right to substitute equivalent items. If an error is made and a product is listed at an erroneous price, PC Mall may, at its discretion, refuse or cancel any orders placed at the incorrect price. If an order has been confirmed and charged to your credit card at the incorrect price, PC Mall shall have the right to immediately issue a credit in the amount of the incorrect price. In the event that this arbitration provision is unenforceable, any litigation regarding this agreement or any transaction between the customer and PC Mall shall be brought in the state or federal courts located in Los Angeles County, California, and the customer hereby agrees and submits to such jurisdiction and venue as exclusive and proper.
